By registering and placing an order on www.pranjalarts.com (‘the Website’) you acknowledge that you are bound by the terms and conditions listed below:

GENERAL TERMS

The artworks made available for sale on the Website may not always be in the physical possession of Pranjal Arts and may be physically located anywhere in the world.

All artworks made available for sale on the Website will be sold at the price listed and no discounts will be granted to the buyer. The price of the art work listed does not include duties, taxes, shipping and handling, which will be charged as applicable and would depend on the physical location of the artwork as well as the shipping address provided by the buyer. The information provided during registration or amended at the time of finalizing a purchase shall be the final billing address and shipping address for delivery of the artworks.

The buyer agrees that the buyer is liable for any duties and taxes that might be applicable on the purchase as per clause 2 above and such charges shall be payable in addition to the price of the artwork.

All invoices will be raised by Pranjal Arts Gallery based on the registration information provided by the buyer or amended at the time of finalizing a purchase and payments will be accepted only from the buyer so registered. In the event that a payment is sent from elsewhere, it may either be returned or could result in a delay in the processing of the order until management decides whether a variation from the registration details may be accepted.

Placing an order on www.myindianart.com constitutes an irrevocable acceptance of the purchase. Unless rescinded/cancelled by Pranjal Arts within 2 working days on account of a default by the seller or any prior or continuing breach by the buyer, such acceptance results in an enforceable contact of sale. The contract of sale is between Pranjal Arts (acting as the agent of the Seller) and the buyer.

Once an order is placed on Pranjal Arts the buyer is required to make payment for the price of the artwork as well as the charges referred to above within 7 working days from the date of placing the order. In the event that Pranjal Arts does not receive payment within 7 working days it reserves the right to cancel the order without prior notice to the buyer. Alternately, and without prejudice to the foregoing, Pranjal Arts may, at its absolute discretion, hold the artwork for the Buyer and charge any storage and insurance costs applicable on the purchase and/or may seek to commence legal proceedings (acting as the agent of the Seller) to ensure execution of the contract of sale.

The artworks will be delivered/shipped to the Buyer once all necessary documentation, relating to transportation, tax, etc. as may be reasonably requested for by Pranjal Arts are completed and payment has been realized in full including any additional charges. Transit insurance costs will be included in such additional charges, unless specifically advised otherwise by the Buyer. In the event that the buyer chooses to himself collect the artworks from Pranjal Arts he must do so within two weeks of Pranjal Arts receiving the payment. In the event that the artworks are not so collected within a period of two weeks, storage and insurance costs will be applicable on the purchase and will be determined at the complete discretion of Pranjal Arts.

You agree to abide by all provisions prescribed in these terms and conditions. In particular, you warrant that all information that you submit will be true and accurate (including without limitation your credit card number and expiration date), and you agree to pay all costs, charges plus all applicable taxes for the purchases made by you.

Pranjal Arts is authorized by the Sellers to exercise complete discretion in (i) the illustration and descriptions of art works for viewing and sale and (ii) acceptance or rejection of orders received.

All artwork displayed on the Website is supported by an authenticity guarantee from the Seller. Based on this, Pranjal Arts will issue a specific authenticity guarantee for every artwork sold on the Website.

Pranjal Arts is not obligated to provide any physical preview of the artwork either before or after the sale. Pranjal Arts is in no way liable for the condition of the artwork. Condition reports are provided on request and are based on the information provided by the Seller. In the event that Pranjal Arts is of the view that there is a significant difference in the physical work relative to its appearance as displayed on the website, an email will be sent to the buyer regarding the difference and Pranjal Arts will await the buyer’s decision to proceed with the order.

All foreign currency exchange rates for the purchase are made based on the USD:INR forex rate prevailing on the day of confirmation of order. The prices for individual artworks have been 'rounded off' for ease of reference and do not necessarily reflect the exact exchange rate that will be used for calculation of the invoiced price.

The buyer warrants that all the information furnished at the time of registration is true and correct and any change in the information provided will be updated and intimated to Pranjal Arts immediately. Pranjal Arts is entitled to act on the basis of the information provided and seek such further information, clarifications or verifications as it may deem necessary for granting registration. Such registration may be suspended or cancelled where Pranjal Arts forms a reasonable view that any of the above information may be inaccurate. However, such registration will be restored immediately on the buyer furnishing information to the satisfaction of Pranjal Arts.

PRIVACY POLICY

Thank you for visiting Pranjal Arts. We understand and respect your privacy and consider it an important element of our business.  This notice describes our privacy policy and broadly pronounces how we handle the information we gather.

1. Background

1.1 This document is an electronic record in terms of (i) Information Technology Act, 2000; (ii) the rules framed there under as applicable; and (iii) the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

1.2 This Privacy Policy (“Privacy Policy”) is published in accordance with: (i) Section 43A of the Information Technology Act, 2000; (ii) Regulation 4 of the Information Technology (Reasonable security practices and procedures and sensitive personal information) Rules, 2011 (“SPI Rules”); and (iii) Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the privacy policy that is applicable in relation to the access or usage of Pranjal Arts (“Website”).

1.3 This Privacy Policy covers: (i) the type of information collected from the users through the Website including sensitive personal data or information; (ii) the purpose, means and modes of usage of such information; and (iii) how and to whom such information which has been collected will be disclosed.

1.4 For the purpose of this Privacy Policy, wherever the context so requires "You", “Your” or “User” shall mean any natural or legal person who uses the Website for availing services offered by the Website (“Services”). The terms “We”, “Us”, “Our” shall mean “com”.

1.5 We reserve the right to make changes to this Privacy Policy at any time. We will provide notice of any significant changes through the Website, or by other means so that you may review the changes before you continue to use the Website. Any such modifications will become effective immediately upon posting to the Website and your continued use of the Website, and/or the Services constitutes your consent to such modifications. If you object to any changes, you may close your account. You agree to periodically review the current version of the Privacy Policy as posted on the Website.

2. Type of information collected from the customer

2.1 For the purpose of this Privacy Policy, “personal information” as defined under Section 2(i) of the SPI Rules means, any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

2.2 “Sensitive personal information” as defined under Section 3 of the SPI Rules means such personal information which consists of information relating to:

  • password;

  • financial information such as Bank account or credit card or debit card or other payment instrument details ;

  • physical, physiological and mental health condition;

  • sexual orientation;

  • medical records and history;

  • biometric information;

  • any detail relating to the above clauses as provided to body corporate for providing service; and

  • any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

2.3 We require Customers who avail our service through the Website to provide us with the following information:

  • Name of the Customer

  • E-mail Address

  • Phone Number

  • Address

  • Credit card or debit card information which is required for payment purposes.

  • Demographic information such as postcode, preferences and interest

  • All other information as required by Us to register/ provide the Service to the Customer on the Website.

2.4 We require the Vendors who avail our service through the Website to provide us with the following information:

  • Name of the Vendor

  • E-mail Address

  • Phone Number

  • Postal Address

  • Tax-Payer Identification Number

  • All other information as required by Us to on-board the Vendor on the Website.

3. How the collected information will be used

3.1 Sensitive Personal Information and other information collected Clause 2 shall be used in the manner described below: 

  • Registered user name: The registered user name shall be used to customize the Services availed by the user through the Website and to personalize all communications that are sent to the user by us. 

  • E-mail Address: Your E-mail address will be used to communicate:

               - Confirmation of your order booking;

               - Details regarding payment for the orders placed;

               - Feedback from customers regarding the products and services provided by us; and

               - Communication of delivery of orders placed by you.

  • Phone Number: Phone number will be an alternative method to contact the user for any matter related to the services to be availed by you.

  • Address: The address can either be your residential address or official address or the address of the receiving party to whom the consignment is transported. The same shall be provided to the driver of the vendor carrying the consignment in order to deliver the consignment at the location specified by the user on the Website. 

  • Credit Card/Debit Card information: Credit Card/Debit Card information is used for charging the user for making purchases on the website. 

  • The Tax-Payer Identification Number collected from the Vendors shall be used to verify the Vendor and to generate an invoice. 

  • In order to improve the quality of our Services we may ask you to provide us with information regarding your experiences with our products and/or services. Users have the option of choosing not to provide us with this information. 

  • We will use your registered account transaction information which includes all information pertaining to your registered account activity, Products ordered, payments made, orders cancelled, modified and the like and communications pertaining to the same in order to assess the credibility of the user. 

  • We may use your information to send you promotional information pertaining to the Products and/or Services provided by us. 

  • We reserve the right to ask you, at the time of registration with the Website or thereafter, for documentary proof of your identity or other data or postings provided by you with respect to the registration or otherwise. In the event that you fail to provide us with this information or documentary proof, we reserve the right to refuse registration or to terminate your user agreement immediately and cease to provide any Services to you.

4. Disclosure of Personal Information

4.1 All financial information that is collected through the Website is used solely to bill for the services availed by the user, and is not used for marketing or promotional purposes. Towards this end, we disclose such information to a third-party intermediary, for the sole purpose of credit card processing, which is used to make payments to avail of the services on our Website.

4.2 We may also disclose certain information to third parties solely to help diagnose technical problems, to administer the Website, and improve the quality of the Services provided by us.

4.3 We reserve the right to disclose any personal information as required by law and when we believe, at our sole discretion that disclosure is necessary to protect our rights, protect someone from injury and/or to comply with a judicial proceeding, court order, or legal process served on our Website.

5. Cookies

5.1 The Website uses temporary cookies, which are files that your web browser puts on your system when you visit a website, to store certain information that is not sensitive personal information. The information collected through these cookies is used by us for the technical administration of the Website, research and development, and to improve the quality of our services.

5.2 We may use third party cookies to track visitor behaviour and to improve the quality of our services. However, such cookies will not store any kind of personal information, nor will such information be disclosed to any third party.

5.3 These cookies are intended to be automatically cleared or deleted when the User quits the browser application. You are encouraged to use the “clear cookies” functionality of your browser to ensure such clearing / deletion, since it is impossible for us to guarantee, predict or provide for the behaviour of your system.
